Letter Tacit Elections

To members of the CERN-ESO Pensioners’ Association

Subject: Partial renewal of the Committee members of the CERN-ESO Pensioners’ Association and renewal of the auditors for the years 2014 and 2015.

Dear Madam, Dear Sir, Dear Members of GAC-EPA,

In conformity with article 19 of our current statutes, on 2 September 2013 we sent out an appeal for candidates for the election of 13 members of the Committee and two auditors. We received 12 candidacies for Committee membership and one candidacy for auditor. The number of candidacies is thus smaller than the number of vacancies in both cases.

We had a similar occurrence in the past and it was decided to carry on with the normal voting procedure with voting papers sent out etc. This decision was criticized as excessively procedural, correctly so in my opinion, since the result of the elections was known in advance (with the hypothetical exception that a candidate could receive zero votes and even in this hypothetical case the candidate could be a member of the Committee since our statutes do not mention a minimum number of votes necessary for a valid candidacy).

Even though our statutes do not explicitly say so, common sense leads us to opt for a tacit election of the candidates whose candidacy is valid according to articles 5 and 19 of our current statutes. Were some of you to object to this pragmatic decision of the Committee dictated by common sense and a desire for efficiency, I invite you to inform us of your objections in writing to the address above within 15 days of reception of this letter. After this deadline the persons below will be declared elected by this tacit electoral procedure.

Auditor for the years 2014 and 2015:

During normal elections ESO members also elect their representative to the Committee from the candidate(s) announced. Since there is only one candidacy for an ESO representative on the Committee (Martin Cullum), we propose that ESO members accept his tacit election as their representative. If an ESO member has any objections, I invite her/him to communicate with us as above.

I am convinced that by proceeding with a tacit election we are saving time, energy, and money for our Association and its Committee, and in particular for those organizing the elections and for you our members, without violating the spirit of our statutes and without corrupting the democratic process constituting the organs of our Association.
